DMCA Policy

Effective Date: [Insert Effective Date]
Last Updated: [Insert Last Updated Date]

ImagineTool (“we”, “us” or “our”) respects the intellectual property rights of others and expects everyone who uses imaginetool.site to do the same. This policy explains how copyright owners can report suspected infringement under the United States Digital Millennium Copyright Act (“DMCA”), and how we respond. We also act on valid copyright complaints from other countries in line with applicable law.

How ImagineTool Handles Content

ImagineTool provides online tools for editing, converting and processing files. Users keep ownership of their files, and many tools process files directly in the user’s browser. When a feature uses server-side or third-party processing, files are handled automatically and deleted after processing is complete. We do not publicly host, publish or share the files users process, and we do not review them in the ordinary course of operating the Service.

Because of this, infringement concerns on our website usually involve one of the following: content on our own web pages (such as text, images or sample material), links or ads that point to infringing material, or a user who is misusing a tool to copy or alter protected works. If you believe any of these affects your rights, please contact us using the process below.

Submitting a DMCA Takedown Notice

If you are a copyright owner, or are authorised to act on behalf of one, and you believe material on our website infringes your copyright, please send a written notice to our designated contact. To be valid under 17 U.S.C. § 512(c)(3), your notice should include:

  1. Your physical or electronic signature, or that of a person authorised to act on your behalf.
  2. A description of the copyrighted work you claim has been infringed. If several works are covered, a representative list is fine.
  3. A description of the material you claim is infringing, with enough detail, such as the exact page URL(s), for us to locate it.
  4. Your full name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.

Where to Send Your Notice

Email: support@imaginetool.site (subject line: DMCA Notice)

Designated Copyright Agent: [Insert agent name and postal address, as registered with the US Copyright Office]

Please do not include sensitive personal information that is not needed to process your complaint. We may share a copy of your notice, including your contact details, with the person who is responsible for the content, as part of the process.

What Happens After We Receive a Notice

Review

We review each notice to check that it is complete. If key information is missing, we may ask you for more details before taking action.

Action

If the notice is valid, we will act quickly to remove or disable access to the material identified, or to take other reasonable steps within our control, such as removing a link.

Notification

Where possible, we will let the affected user or site contributor know that the material was removed or disabled because of a complaint, and we will provide a copy of the notice.

Submitting a Counter-Notice

If you believe that material was removed or disabled by mistake or misidentification, you may send us a counter-notice. It must be in writing and include:

  1. Your physical or electronic signature.
  2. A description of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification.
  4. Your name, address, telephone number and email address.
  5. A statement that you consent to the jurisdiction of the federal court for the district where your address is located (or, if outside the United States, any judicial district where ImagineTool may be found), and that you will accept service of process from the person who filed the original notice or that person’s agent.

Send your counter-notice to support@imaginetool.site with the subject line DMCA Counter-Notice.

When we receive a valid counter-notice, we will send a copy to the original complainant. Unless that person tells us within 10 business days that they have started a court action to stop the alleged infringement, we may restore the material within 10 to 14 business days after receiving your counter-notice, as the law allows.

Repeat Infringer Policy

In appropriate circumstances, we will suspend or block access for users who are repeat infringers. We decide this on a case-by-case basis and may take other steps to prevent abuse of our tools.

Responsibilities of Our Users

Our Terms of Service require users to upload and process only files they own or have permission to use. Using ImagineTool to infringe another person’s copyright is prohibited. Users remain solely responsible for the files they process and for how they share or publish the results.

Third-Party Advertising and Links

Our website may display ads from third parties, such as Google AdSense, or link to external sites. We do not control that third-party content. If you see an advertisement or link that you believe infringes your rights, please tell us the page where you saw it and contact the relevant provider as well, because we may not be able to remove content hosted elsewhere.

False or Bad-Faith Claims

Please be careful when sending a notice. Under Section 512(f) of the DMCA, a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. If you are not sure whether something infringes your copyright, you may wish to speak with a qualified lawyer first. Doing so helps keep the process fair for everyone.

Trademarks and Other Rights

This policy covers copyright complaints. If your concern involves trademark, privacy, defamation or another legal right, please email support@imaginetool.site with details and we will review it in accordance with applicable law.

Changes to This Policy

We may update this DMCA Policy from time to time. The latest version will always be posted on this page with an updated date.
